Terms & Conditions

Last updated: July 23, 2026. These Terms govern your engagement with Exceptional Ad Agency.

Exceptional Ad Agency ("EAA," "we," "us") provides performance marketing, conversion rate optimisation (CRO), social media marketing, retention marketing, and ad creative services to D2C and e-commerce brands. By booking a strategy call, making a payment, or engaging our services, you agree to these Terms.

1. Eligibility & Scope of Services

Our services are designed for D2C/e-commerce brands, including startups scaling from zero and established brands generating revenue. Services include Meta Ads, Google Ads, YouTube campaigns, CRO for landing pages/checkout flows, email and WhatsApp retention flows, and ad creative production. Exact deliverables are confirmed during onboarding and may vary by plan.

2. Client Requirements

To deliver results, we require access to your Meta Ads account, Google Ads account, and Shopify store, along with 1–2 hours of your time during onboarding. Delays in providing access may affect project timelines.

3. Pricing

Select engagements (e.g., our 40-day scaling program) require an upfront token payment of $500 to begin work, with the remaining balance tied to agreed performance outcomes. Pricing for other engagements is confirmed individually after the strategy audit call.

4. Performance Guarantees

Any growth or revenue guarantees mentioned on our website or in sales communication apply only under the specific conditions stated for that program (e.g., minimum growth percentage within a defined timeframe) and require the client to provide requested access and cooperation throughout the engagement.

5. Intellectual Property

Ad creatives, copy, and campaign assets produced for a client become the client's property upon full payment. EAA retains the right to showcase anonymised results and creative work in its portfolio unless the client requests otherwise in writing.

6. Termination

Either party may terminate an engagement per the notice period agreed at onboarding. No long-term lock-in contracts are enforced beyond the active program period.

7. Limitation of Liability

EAA is not liable for losses arising from third-party platform policy changes (Meta, Google, Shopify) outside our control.
